1. Introduction

Welcome to Kiwidu. These Terms of Service govern your use of our platform and provide information about our service. By accessing or using Kiwidu, you agree to be bound by these terms.

Please read these terms carefully before using our platform. If you do not agree with any part of these terms, you may not access or use our service.

2. Definitions

"Platform" refers to the Kiwidu website, mobile applications, and services.

"User" refers to any individual who accesses or uses the Platform.

"Content" refers to any text, images, videos, audio, or other material that is posted, uploaded, or otherwise made available on the Platform.

"Creator" refers to Users who produce and share Content on the Platform.

3. Account Registration

To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms.

4. User Content

Our Platform allows Users to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material. You are solely responsible for the Content that you post on the Platform.

By posting Content on the Platform, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Platform.

You represent and warrant that: (i) the Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Platform does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Platform for any illegal purpose or in violation of any local, state, national, or international law
  • Harassing, threatening, or intimidating other Users
  • Posting or transmitting Content that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful, fraudulent, or otherwise objectionable
  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity
  • Interfering with or disrupting the Platform or servers or networks connected to the Platform
  • Attempting to gain unauthorized access to parts of the Platform that are restricted

6. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of Kiwidu and its licensors. The Platform is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kiwidu.

7. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

If you wish to terminate your account, you may simply discontinue using the Platform, or notify us that you wish to delete your account.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.

9. Limitation of Liability

In no event shall Kiwidu, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.
